Burden of proof

Burden of proof:

The Supreme Court in Gian Chand v. State of Punjab, 1983 (13) E.L.T. 1365 has held the burden of proof is on the prosecution to prove that the person is guilty of an offence. That means to say that the person who points the finger must al so prove that the other person is guilty.

Further, the Supreme Court in V.D. Jhingan v. State of U.P. AIR 1966 S.C. 1762 had held that the prosecution has to prove its case beyond all reasonable doubt.
