Exemption of Employer from Liability :

Where an employer is charged with an offence punishable under this Act, he can, after giving three days clear notice of his intention to do so, bring any other person whom he charges as the actual offender, before the court at the time fixed for hearing the charge, and if, after the offence has been proved, employer proves to the satisfaction of the court that-(i) he has used due diligence to enforce the execution of this Act, and (ii) the said person committed the offence in question without his knowledge, consent or connivance. There the other person responsible for the occurrence shall be convicted of the offences and shall be liable to the like punishment as if he were the employer and the employer shall be discharged from any liability under the Act in respect of such offence.
